FACTS:
Information No.A5197 was filed by Stipendiary Steward, Mr N G McIntyre, against Licensed Public Trainer, Mr L C Driver, alleging a breach of Rule 865 (2) in that Mr Driver, as the trainer of MELTON EXPRESS in Race 1, Horncastle Homes Mobile Pace, presented that horse to race without the notified blinds.
The information was filed with the Registrar on racenight and was served on Mr Driver at the meeting of Rangiora Harness Racing Club on 19 August 2012. Mr Driver informed the Stewards at that time that it was his intention to, possibly, defend the charge so the hearing of the information was adjourned and was heard at the meeting of New Zealand Metropolitan Trotting Club on Friday, 24 August 2012.
Mr Driver had signed the Statement by the Respondent on the information form indicating that he admitted the breach.
Rule 865 provides as follows:
(2) Every horse entered in a totalisator race shall be presented in the assembly area prior to the race in the same notifiable gear as that notified under sub-rule (1).
SUBMISSIONS:
Mr S P Renault, Stipendiary Steward, told the Committee that Mr Driver had presented MELTON EXPRESS on to the track for the race with no blinds. It had been notified under Rule 865 (1) that the horse would race in blinds. Mr Renault said that the horse was having its first start for Mr Driver’s stable.
DECISION:
Mr Driver having admitted the breach, the charge was found proved.
PENALTY SUBMISSIONS:
Mr Renault submitted that, had Mr Driver been available on racenight, the breach would have been dealt with by way of a fine of $100 under the Minor Infringement System. He submitted that a fine of that amount was appropriate.
PENALTY REASONS:
The Committee accepted Mr Renault’s submission that a fine of $100 was appropriate, that being the amount of fine for a breach of the Rule under the Minor Infringement System.
PENALTY:
Mr Driver was fined the sum of $100.
