DECISION AND REASONS:
--Following the running of Race 6, Robbie's Bar & Bistro 305 Cranford Street Mobile Pace, an information was filed by Stipendiary Steward, Mr N G McIntyre, against Licensed Open Driver, Mr A J McPherson, alleging that Mr McPherson (as the driver of ERNESTLORDRUTHERFORD in the race) "drove the majority of the straight with his foot out of the sulky footrest".
----Mr McPherson had signed the Statement of Defendant on the information form indicating that he admitted the breach of the Rule and, further, that he did not wish to be present at the hearing of the information. The charge was found to be proved.
----Mr McIntyre showed ERNESTLORDRUTHERFORD racing in the trail and enter the passing lane. Mr McPherson had one foot out of the sulky rest for almost the entire length of the straight. He said that Mr McPherson had simply had his foot out of the rest for too far. He had a clear record as far as this particular Rule was concerned.
----Mr McPherson was fined the sum of $100.
