Following the running of race 8 the Chester Plumbing & Bathroom Handicap Pace an information was filed by Mr Wallis alleging that…G Smith (Take After Me) drove carelessly in the run home when shifting outwards checking Vibhuti who in turn checked Ranfurly Rulz…
Rule 869 (3) (b) reads: No horseman in any race shall drive
(b) carelessly.
Mr Smith admitted the charge and appeared at the hearing.
Mr Wallis, with the aid of the video replays, showed the relevant positions of Take After Me, Vibhuti and Ranfurly Rulz prior to the incident in the home straight. Take After Me was trailing the leader Mr Franklin into the final straight, with Vibhuti on the outside of Take After Me. Mr Smith had waited until the 150m mark before shifting outwards, but in doing so had come into contact with Vibhuti which broke from its gait. There was a resulting check (minor) to Ranfurly Rulz on its outside.
Mr Smith stated he had opted to sit in the trail as his horse was better suited for a late run. When he realised he had lost the opportunity to improve into the passing lane he had shifted outwards. He believed his horse had ducked out a bit causing the contact with Vibhuti on its outer. He said it was not intentional on his part.

Mr Wallis said Mr Smith had 321 drives last season and 189 this season. He had admitted the breach at the first opportunity and had a very good record for this rule. His last breach of this rule was in June 2014. The JCA Penalty Guidelines recommended a penalty of 10 drives suspension or a fine of $500.
Mr Smith said he was not aware of the new penalties. He preferred a fine as opposed to a suspension as he had a drive in the Sales Series Final.
Reasons for Penalty:
Mr Smith is given credit for his early admission of the breach at the first opportunity, his excellent record and that he cooperated fully with the Stewards. A fine in the mid range is appropriate in this instance.
