Following the running of race 1 the Bishopdale/Bush Inn TABS-Tavern Harewood Mobile Pace an information was filed by Mr Wallis alleging that…R Sissons (Smokin Chick) drove carelessly near the 1500m when allowing his horse to shift inwards checking Lexington Lad (G Turner) which broke from its gait…
Rule 869 (3) (b) reads: No horseman in any race shall drive
(b) carelessly.
Mr Sissons admitted the breach and appeared at the hearing.
Mr Wallis demonstrated, with the use of the video replays, the relevant positions of Smokin Chick and Lexington Lad prior to the incident. He stated that as the field approached the 1500m mark Smokin Chick was in the parked out position. Improving on its outer was Bandana in a three-wide position. Bandana moved forward to take up the parked out position and Smokin Chick was in the one-out one-back position. At this point (1500m) he alleged that Mr Sissons allowed his horse to shift inwards with his inside sulky wheel coming into contact with the off side hind leg of Lexington Lad. This caused Lexington Lad to break from its gait for several strides before settling.
Mr Sissons accepted the evidence as presented by the Stewards.

Mr Wallis said Mr Sissons had admitted the breach at the first opportunity and had a clear record under the rule. Last season Mr Sissons had 13 drives and this season has had 22 drives to date. He was a busy Amateur driver. The JCA Penalty Guide recommended a start point of 10 drives or a fine of $500.
Mr Sissons said he was driving in the Amateur Series Final in Auckland on Sunday and would prefer a fine as opposed to a suspension.
Reasons for Penalty:
The committee believes a fine is appropriate in this instance. We take a starting point of $500 and give Mr Sissons credit for his early admission of the breach and his excellent record under the rule.
