Decision:

Following the running of Race 6, Covers ‘N’ Others Handicap Trot, an information was filed by Stipendiary Steward, Mr S P Renault, against Holder of Licence to Train, Mr G R Rich, alleging a breach of Rule 864 (2) (d) in that Mr Rich “as the trainer/driver of SPOT OF GOLD, failed to affix the removeable earplugs so as not to malfunction”.

Following the running of Race 6, Covers ‘N’ Others Handicap Trot, an information was filed by Stipendiary Steward, Mr S P Renault, against Holder of Licence to Train, Mr G R Rich, alleging a breach of Rule 864 (2) (d) in that Mr Rich “as the trainer/driver of SPOT OF GOLD, failed to affix the removeable earplugs so as not to malfunction”.

Mr Rich was present at the hearing of the information and indicated that he admitted the breach. The charge was found proved accordingly.

Rule 864 provides as follows:
(2)   Every horseman, owner, trainer and assistant thereof shall with regard to that horse ensure that:-
       (d)   all gear is correctly applied and/or affixed so as not to malfunction or come adrift.

Mr Renault showed a video replay of the final 300 metres of the Race. He pointed out Mr Rich, wide out, attempt to activate the removeable earplugs shortly after entering the home straight. Mr Rich reported after the Race that they had malfunctioned. He informed the Committee that he was not aware of the malfunction until after the Race. He was not able to explain the malfunction other than that he had made a change to his method of fitting the earplugs to prevent the mare getting her head down and pulling the earplugs out.

Mr Renault recommended a fine of $100.

Mr Rich was fined the sum of $100.
