We exercise our discretion and pursuant to r 1003(2) BETTOR’S BRIGADIER is disqualified from 4th placing.

Amended placings are:

1ST - 3 CHRISTIAN RULER
2ND - 6 JOHNNY BRAVO
3RD - 5 PRINCESS DELIGHT
4TH - 1 ROB’S IDEAL
5TH - 2 AQUINAAH

Stakes and dividends are to be paid accordingly.

Facts:

Mr Allison, stipendiary steward, alleged that BETTOR’S BRIGADIER broke for greater than 50 metres over the final 200 metres.

Judge’s placings were:

1ST - 3 CHRISTIAN RULER
2ND - 6 JOHNNY BRAVO
3RD - 5 PRINCESS DELIGHT
4TH - 4 BETTOR’S BRIGADIER
5TH - 1 ROB’S IDEAL

Submissions for Decision:

Mr Allison demonstrated on the videos that BETTOR’S BRIGADIER galloped just before the 100 metre marker and then continued in a gallop in excess of 80 metres. He pointed out that BETTOR’S BRIGADIER settled just before the winning post.

Mr McLachlan accepted that the distance BETTOR’S BRIGADIER galloped was in excess of 50 metres.

Reasons for Decision:

We assess BETTOR’S BRIGADIER to have galloped some 85 metres to near the winning post. This is clearly in excess of the 50 metres and pursuant to para (b) of the Breaking Horses Regulations BETTOR’S BRIGADIER is deemed to be in breach of r 870(3) in that he has failed to promptly regain his proper gait. 

We are satisfied that the horse that finished 5th, ROB’S IDEAL, paced the whole way.
