We exercise our discretion pursuant to r 862(2) and (3) and refrain from relegating or disqualifying JACCKA CREEK from 3rd placing as we are satisfied that the horse did not gain any advantage from the breach of the rule.

Stakes and dividends are to be paid accordingly.

Facts:

Mr Allison, stipendiary steward, alleged that JACCKA CREEK (B Gray) started from the incorrect barrier position by starting from the inside of the 2nd line instead of outside and behind the front line. 

Judge’s placings were:

1ST - 7 ANOTHER SUPERSTAR

2ND - 3 ROCKER BILLY REBEL

3RD - 9 JACCKA CREEK

4TH - 6 STARLIGHT INVASION

5TH - 1 VOLUME CONTROL

Submissions for Decision:

Mr Allison demonstrated on the video that JACCKA CREEK started from the unruly position near to the inside of the track. He pointed out that JACCKA CREEK was behind the mark.

JACCKA CREEK was slow away and settled near the rear of the field and remained there for the first lap. The horse then progressed gradually around the field before running on fairly finishing in 3rd place.

Mr Gray stated that he accepted he had started from the wrong mark but did not believe he had gained any advantage as he was slow away.
 

Reasons for Decision:

We find that JACCKA CREEK did start from the wrong barrier position in that instead of being towards the outside of the track and just inside the 2nd horse on the unruly mark, JACCKA CREEK started behind the horse that had drawn 2 on the front. Significantly, the horse was not in front of its correct mark.

JACCKA CREEK was slow and settled near the rear of the field. The horse gained no advantage from starting close to the inside of the track and in breach of r 860(5).
