Facts:
Following the running of Race # 3 the Northern Tavern/ Kubala Seeds Gore Mobile Pace an information was filed by Stipendiary Steward Mr C Allison alleging that junior horseman Mr C Ferguson (CJ’S DELIGHT), when improving to the inside of CULLENS ATOM (A Beck), failed to ensure the his sulky did not protrude inside the marker line.
Mr Ferguson was present at the hearing and indicated he admitted the breach.
Open horseman Mr M Jones was also present supporting Mr Ferguson.
Rule 869 (7a) (b) provides as follows;
(7A) Every Horseman who moves inwards shall ensure
(b) That any part or the sulky does not protrude inside the marker line.
Mr Allison showed video replays or the incident from several angles.
Mr Allison highlighted CJ’S DELIGHT, when attempting to improve on the inside of CULLENS ATOM, the sulky protruded inside the marker line for a short distance.
Mr Ferguson acknowledged he had simply made an error of judgement.
Mr Jones supported Mr Ferguson and stated that it was unfortunate but his actions had no consequences to the outcome of the race.

Mr Allison informed the committee that Mr Ferguson was a very successful and busy Junior Horseman. He had no previous breaches under this rule in the past 12 months.
Mr Ferguson had 245 drives in the 2013/2014 season and has had 238 drives this season.
Mr Allison also confirmed Mr Ferguson had admitted the breach at the earliest moment and should be given some credit for this.
Mr Ferguson made no submissions on penalty.

In determining penalty the committee considered the starting point of a $200 fine or four drives as provided by the JCA Penalty Guide. Mr Ferguson was given a $50 reduction for his clear record and admittance of the breach.
