Mr Lee having admitted the breach, the charge was found proved.

Facts:

Following the running of Race # 11 the Michael Griffin Harcourts/Dr Peter Finlayson Mobile Pace an information was lodged by Stipendiary Steward Mr C Allison alleging that G Lee (MIGHTY EMPIRE) shifted ground outwards checking SUPERFREAK (E Swain) on its outside.

Mr Lee was present at the hearing and indicated he admitted the breach.

Rule 869(3) (b) provides as follows:

                (3) No horseman shall in any race drive

                 (b) carelessly

Mr Allison showed video replays of the incident from several angles with approximately 500 metres to run. He pointed out Mr Lee shifting ground outwards from the trail, resulting in SUPERFREAK (E Swain) breaking on its outside, when attempting to move forward.

Mr Lee submitted that it was a very marginal movement outwards and that he had made a simple error of judgement.  He did not believe any contact had been made with SUPERFREAK.  

Submissions for Penalty:

Mr Allison informed the committee that Mr Lee had an outstanding driving record over a long period of time. Mr Lee had no previous breaches under this rule in the past 12 months and had admitted the breach at the earliest possible moment.

Mr Lee had 80 drives in the 2013/2014 season and 87 drives this season.

Mr Allison submitted that he believed the level of carelessness to be at the low end, and that a fine of $200.00 was an appropriate penalty. Mr Lee reinforced to the committee that it was a “close thing” and he had simply made an error of judgement.  

Reasons for Penalty:

In determining penalty the committee had regard to the starting point of a $400.00 for a breach of the rule as provided in the JCA Penalty Guide. Mr Lee’s admission of the breach and clear record, and the low end of carelessness were mitigating factors warranting a $200 discount.
