Mr Knowles explained that scratchings for the day closed at 5pm, Wednesday 14th January 09. Mr Gray actually scratched the horse at 8.40am on Thursday 15th January 09. Mr Gray, in mitigation, explained that the horse was sold to Australian clients and he understood that the horse was still to start. The new owners informed him (after paying purchase price) that they did not want to race the horse. Mr Gray then had no choice but to scratch FRANCO AMBASSADOR. Mr Knowles stated that Mr Gray had a completely clean sheet over the last 12 months. DECISION: Taking onto account: the Committee decided to fine Mr Gray the sum of $200. A Dennis Chairman
