Facts:
Following the running of Race 6, the Haras de Trotteurs 3-Y-O Fillies Oaks Mobile, an information was filed by Mr Tidmarsh, Stipendiary Steward, alleging Mr T Williams “…drove LUBY LOU carelessly entering the first bend when insufficiently clear of SHOW GAIT which was checked.”
Rule 869 provides as follows:
(3) No horseman in any race shall drive: -
(b) carelessly.
Mr Williams admitted the breach and appeared at the hearing.
Mr Tidmarsh stated Luby Lou had drawn 4 and Show Gait (S Ottley) 1 behind the mobile at the start. On entering the first bend Show Gait was on the pole line with Luby Lou crossing over from wider out. He said Mr Williams had misjudged his inwards shift which resulted in Show Gait striking Luby Lou’s wheel, causing Show Gait to break. Show Gait had galloped for a considerable distance and lost its chances.
Mr Williams stated he believed Miss Ottley intended giving him the lead and then changed her mind and had chased her filly up when entering the bend. He said Luby Lou was having only its third start and he was conscious of keeping her balanced when entering the bend. He said she had a tendency to lay inwards and Show Gait had struck the back of his wheel as he crossed over.

Mr Tidmarsh said Mr Williams had driven 141 times this season and 262 time last season. He had an excellent record under this rule with no previous breaches in the past 12 months. Mr Williams had admitted the breach at the first opportunity. An aggravating feature was that Show Gait had missed an opportunity to finish out a feature race.
Mr Williams stated he had admitted the breach at the first opportunity and had a good record from a limited number of drives. He preferred a fine as opposed to a suspension.
