The Committee ruled that SHE’S GALLANT, had been prevented from taking an effective part in the race due to an occurrence that materially prejudiced the horse's chances.
It was ordered that SHE’S GALLANT be declared a non-starter.
Facts:
Following the running of Race 3, the Cup Week Tickets on Sale Now Rating 65, an Information was filed by Stipendiary Steward, Mr M Davidson, requesting a ruling under Rule 632 as to whether SHE’S GALLANT, ridden by Mr Mudhoo, who reared prior to the start and was held when the gates opened, received a fair start.
Mr R Mudhoo, rider of SHE’S GALLANT, was present at the hearing of the Information.
Rule 632 (1) provides as follows:
If, in the opinion of the Judicial Committee, a horse which does not finish in the first three placings was prevented from taking an effective part in a Race owing to the mechanical failure of starting stalls, or is denied a fair start and such occurrence materially prejudiced the chances of that horse (but not where the horse is slow away of its own accord), the Judicial Committee may declare such horse to be a non-starter.
Submissions for Decision:
Mr Davidson showed back straight/head-on video replays of the start of the race, a 1400 metres event. He pointed out SHE’S GALLANT, ridden by Mr Mudhoo, drawn the number 6 gate in the 13-horse field. Mr Davidson submitted that the Stewards were seeking a ruling that SHE’S GALLANT, was denied a fair start. He showed that SHE’S GALLANT was being assisted in the barrier stall by a Starters Attendant and when the start was declared, SHE’S GALLANT was rearing and denied a fair start.
Mr Mudhoo stated that the horse was starting to rear as the gates were opening and did not receive a fair start.
Reasons for Decision:
The replays of the start were conclusive and clearly showed that SHE’S GALLANT was rearing as the start was made and was on both hind legs as the rest of the field began the race. The Committee determined that this occurrence had affected SHE’S GALLANT, had materially prejudiced the horse’s chances in the race, and therefore SHE’S GALLANT had been denied a fair start.
