--INFORMATION NO 107 has been filed by Race Course Inspector Mr BF McKenzie and alleges a breach of Rule 1002(1) of the Rules of Racing by the Defendant, Licensed Trainer Miss T Croon.
--The charge reads as follows:
--Miss Croon attended the hearing and admitted a breach of the rule. She has agreed that she understood the charge and the rule. Accordingly we find the charge to be proved.
--SUMMARY OF FACTS:
--Mr BF McKenzie told the Committee that on 14th May 2009 at the Cambridge Jockey Club trials Miss Croon entered a 2 year old filly in Heat 2 by HAWKEYE – EL CORIERO. Prior to the heat it was discovered by a NZTR Official, Shona Moore that the top numerical brand did not correspond with NZTR records. As a result of this discrepancy the horse was scratched. From further enquiries it was ascertained that the true identity of the filly was a 2 year old HAWKEYE – OKINAWA. The mistake arose through 2 fillies by HAWKEYE being sent by Mr McKee to Miss Croon to pre-train. Miss Croon failed to verify the correct identity of the 2 fillies against the NZTR records which led to the incorrect entry.

--PENALTY SUBMISSIONS:
--Mr McKenzie said Miss Croon had been negligent in her horse identification management, something which Trainers need to be more careful about. As Miss Croon pleaded guilty he submitted a fine of $300 would be appropriate but that in future this type of mistake could well incur a harsher penalty.
--PENALTY:
--The Committee took into account all the above facts and before imposing a penalty explained to Miss Croon her obligations and how serious this type of error could be. Accordingly we impose a fine of $300.
