1.1           Mr Beckett is charged that on 23rd July 2009 he provided a urine sample which tested positive for the prohibited drug cannabis.  He admits the breach of Rule 528(1).

1.              NATURE OF THE CHARGE

--

1.1           Mr Beckett is charged that on 23rd July 2009 he provided a urine sample which tested positive for the prohibited drug cannabis.  He admits the breach of Rule 528(1).

2.              PENALTY

--

2.1           Mr John McKenzie made comprehensive submissions.  These have reference not only too Mr Beckett but to other licensed persons who appeared before the Committee today.

--

2.2           The Committee is alert to the need to deter the use of prohibited drugs by persons licensed under the Rule of Racing.  Such persons put themselves at risk.  They also put at risk those who work with them.  Mr McKenzie made reference to the landmark judgment given in 1994 by Mr Justice Gendall as he now is.

2.3           Mr Beckett has a good record.  He has told the Committee that he does not now regularly smoke cannabis.  He grew up in the South Island but wishes to work in the racing industry in the Waikato.

--

2.4           Mr McKenzie advocates a one (1) month suspension together with a fine and a payment towards costs.  That is appropriate.  Mr Beckett has been told that he may arrange to pay off the fine and the costs award.  Mr Beckett will be suspended for twenty eight (28) days from the 10th August.  He is fined the sum of $250.00 and ordered to pay the sum of $250.00 to NZTR as a contribution towards its costs.
