The Inquiry has before it an information which sets out three joint charges filed by NZTR against the Defendants MP and BP Baker.

There were also three further informations filed which sought a ruling for the horses FULLY FLEDGED, MOUNTAIN ROAD and NOM DUE JEU to be disqualified.
--The charges against the Defendants were as follows:

1. THAT the horse FULLY FLEDGED was brought to the Racecourse at Te Rapa for the purpose of engaging in the Pulse Engineering Services race at the Meeting of the Auckland Racing Club on Friday the 5 September 2008, (in which said race such horse started) AND THAT such horse had had administered to it a prohibited substance, namely Ranitidine, capable of affecting its speed, stamina, courage or conduct in breach of Rule 1004(2) AND THAT you were the Trainers of the horse AND THAT by virtue thereof you are liable to the penalty or penalties which may be imposed upon you pursuant to Rule 1004(3) of the New Zealand Rules of Racing unless you satisfy the Committee that you had taken all proper precautions to prevent the administration of such prohibited substance.
