DECISION OF JUDICIAL COMMITTEE

Information No. 0815 alleges a breach of Rule 528(1) by Louise Nanette Sapsworth following a routine test carried out at the Matamata Racecourse on the 8 June 2006.

--

The breach was admitted and Racecourse Inspector, Mr B McKenzie confirmed the authority to bring the charge, and that Miss Sapsworth was charged on the basis that she was a track rider.

--

To her credit she was frank and admitted to the Racecourse Inspector and the collection nurse that she was worried because of a recent consumption of cannabis.

--

A sample of urine was supplied and upon analysis by the ESR it was found that sample ID No.346303 for Louise Sapsworth had tested positive to cannabis.

--

A clear sample was provided on the 14 June 2006, and on the 16 June 2006 the ESR provided a certificate stating the re-test sample was clear.

--

Miss Sapsworth is a regular track-work rider, although she held a jockey's licence at the time of the test. It can be confirmed she has not been riding in races for some time, and she should be treated, in terms of penalty, as a track rider, and not a jockey.

--

Miss Sapsworth is a person with an unblemished previous record.

--

In explaining the circumstances, Miss Sapsworth asked the committee to take into account consideration that it was an isolated use on her part, and having just returned from a holiday in Samoa she attended a party and consumed some cannabis, and she was not a regular user.

--

Mr McKenzie submitted that as a track-work rider a fine would be appropriate and suggested a fine of $500 on this occasion, and $200 towards NZTR costs.

--

Miss Sapsworth acknowledged she had no objection to this, and accordingly she was fined $500, plus $200 towards NZTR costs, and $100 JCA costs.
