Following the running of Race 3 on the programme, an Information was lodged against Mr B Weaver, the trainer/driver of PIPER CULLEN, alleging a breach of Rule 864(2)(d), in that the earplugs malfunctioned when an attempt was made to release them.

--Following the running of Race 3 on the programme, an Information was lodged against Mr B Weaver, the trainer/driver of PIPER CULLEN, alleging a breach of Rule 864(2)(d), in that the earplugs malfunctioned when an attempt was made to release them.
--Mr Weaver admitted the breach and elected not to be present during the hearing.
--Explaining the circumstances, Mr Escott reiterated the details presented in the information. He said that trainer/driver Mr Weaver, advised he was unable to release the earplugs in the run home because they malfunctioned. PIPER CULLEN finished strongly down the outside in 4th place.
--In this case, trainer/driver B Weaver, on PIPER CULLEN, has admitted a breach of the Rules, in that the earplugs, which he affixed, malfunctioned and he was unable to release them in the run home. Following a recommendation on penalty, and in keeping with consistency for the breach, I am satisfied a fine of $100 is appropriate and I so order.
