Decision:
Following the running of race four on the programme, an Information was lodged against Mr S Dickson, the driver of Kevin Armbro, alleging a breach of Rule 869(2)(a), in that he used the whip excessively on his horse during the run home.

Following the running of race four on the programme, an Information was lodged against Mr S Dickson, the driver of Kevin Armbro, alleging a breach of Rule 869(2)(a), in that he used the whip excessively on his horse during the run home.
----Mr Dickson admitted the breach.
----Explaining the circumstances, Mr Ydgren referred to the video of the race, which showed Mr Dickson in the trail (on Kevin Armbro). On turning for home, after an initial couple of efforts, when a gap presented itself, Mr Dickson used his whip continuously approximately 21 times and, in the stewards’ view, this is excessive.
----In respect to penalty, Mr Ydgren advised that Mr Dickson had a previous breach under this Rule, in October last, and he was fined $200.00.
----Mr Dickson, in his submissions, said he was trying to get the best out of his horse. He said they weren’t hard hits with 4 or 5 hard hits over the tail which may have made it looked worse than it was. To the chairman, he acknowledged that he was familiar with the recommended guidelines for use of the whip.

----In this case, Mr Dickson has admitted a breach of Rule 869(2)(a) in that, as the driver of Kevin Armbro, he used his whip excessively during the run home.
----The film was shown which clearly showed that, turning for home, Mr Dickson used his whip approximately 21 times which, as acknowledged by him, is excessive.
----In response, he said he was trying to get the best out of the horse and, apart from a few hard hits, was just flicking it up. I don’t accept that. I am mindful of the often used phrase ‘if it looks bad, it is bad’ and, in this case, it did not look good.
----This is a breach that could incur a monetary penalty or period of suspension. In determining penalty, Mr Dickson has a previous breach under this Rule but, to his credit, he has had a considerable number of unblemished drives in the intervening period. Taking that into consideration and given his admission of the breach, I am satisfied a fine is appropriate in this instance. Mr Dickson is fined the sum of $300.00.
