Following the running of race 7, the Hoani Jack Cup Mobile Pace, Information # 68314 was lodged against Mr B J Lilley, the trainer of KENTUCKY TOY BOY, alleging a breach of Rule 865 (2) in that he was late in notifying that the horse would race with pull down blinds on.
--At the commencement of the hearing, the committee was advised that, in Mr Lilley’s absence, KENTUCKY TOY BOY’s owner, Mr P Yesberg, was acting as agent and representing the trainer. He admitted the breach, and elected not to be present. The charge was found proved.
--Explaining the circumstances, Mr Renault said that Mr Lilley had contacted him personally on Wednesday 6th January, after the official notification time had closed, and said he wanted to notify a gear change. He said he was not near a fax, and asked if it could be taken over the phone.
--Mr Lilley was advised that it would be accepted but that, given it was after the official notification time, he would be subject to a charge under the Rules and a recommended penalty of a $50.00 fine. Mr Lilley indicated he accepted this, and wished to continue with the gear change.
--In respect to penalty, Mr Renault recommended the standard fine as conveyed to Mr Lilley and, in the absence of submissions from Mr Lilley and/or his agent, he is fined the sum of $50.00.
