Following the running of Race 5, the Nelson Truck Spares Discretionary Handicap Trot, an Information was filed by Chief Stipendiary Steward Mr N. R. Escott alleging a breach of Rule 869(2(a) by Mr M. A. Pash, the driver of “Begin” (5). It was alleged that Mr Pash used his whip excessively.

Following the running of Race 5, the Nelson Truck Spares Discretionary Handicap Trot, an Information was filed by Chief Stipendiary Steward Mr N. R. Escott alleging a breach of Rule 869(2(a) by Mr M. A. Pash, the driver of “Begin” (5). It was alleged that Mr Pash used his whip excessively.
-- Mr Pash had indicated on the Information that he admitted this breach of
the Rules and that he did not wish to be present at the hearing.
Mr Escott gave evidence and used video coverage to show that Mr Pash
used his whip on about 28 occasions in the run home.
In relation to penalty Mr Escott advised that Mr Pash had no relevant
previous convictions, and as he had admitted the breach a fine of $200-00 was
recommended. We were satisfied that a fine of $200-00 was appropriate in this
case, and accordingly Mr Pash was fined this amount.
