Following the running of Race 1, NZ Community Trust Pace, S R McNally the driver of ELLE ISLAND QUEEN was charged with a breach of Rule 869 (4).
Following the running of Race 1, NZ Community Trust Pace, S R McNally the driver of ELLE ISLAND QUEEN was charged with a breach of Rule 869 (4).
--It was alleged that over the concluding stages of the race Mr McNally improved ELLE ISLAND QUEEN out sharply which resulted in DRAG RACER and BADLANDS FLIP being inconvenienced.
--Mr McNally attended the hearing and admitted the breach of the rule.
--Prior to hearing submissions on penalty the films of the incident were shown, these demonstrated Mr McNally move ELLE ISLAND QUEEN from a position close to the marker line out to about the middle of the track. In undertaking this move both DRAG RACER and BADLANDS FLIP were forced to change ground.
--When presenting his submissions on penalty Mr Escott produced Mr McNally's record, which showed no previous breaches of this rule. Mr Escott stated that he saw this incident sitting toward the lower end of the scale and submitted that a modest fine be imposed.
--Mr McNally, in his submissions, stated that his horse was full of running when he moved out and he had moved out just a little quickly. He asked the committee to take into consideration his admission and his record.

PENALTY
--The committee has carefully considered the submissions from Mr Escott and Mr McNally and concurs that this breach sits towards the lower end. As such the appropriate penalty on this occasion should be a monetary one.
--Having taken into account Mr McNally's admission together with his good record the committee finds that he is fined the sum of $200.00 .
