Decision: -- Following the running of race five on the programme, an Information was lodged against Mr JM Ward, the owner/trainer of Time to Shine, alleging a breach of Rule 865(1)(2), in that the horse was presented to race, and raced, without the nose flap in which it raced on the 9th January 2009. Mr Ward admitted the breach and elected not to be present. Explaining the circumstances, stipendiary steward Mr Ydgren said that it was noted by the stewards after race 5 that the horse, Time to Shine, raced without the nose flap in which it had previously raced. When spoken to, owner/trainer Mr Ward admitted the breach. He said that the stablehand had forgotten to put the nose flap on, and he accepted the responsibility. In respect to penalty, Mr Ydgren said Mr Ward has no previous breaches and, in accordance with other first offences under this Rule, he recommended a $100.00 fine. The committee is satisfied that the recommendation of the stipendiary stewards in this case is appropriate and, acknowledging this is his first such breach, Mr Ward is fined $100.00.
