A second protest followed the running of race 1, the Wild Tomato Trot, lodged by the stipendiary stewards against horse no. 1 ARABESS (C Ford) placed 4th by the judge, alleging a breach of Rule 870 and the Breaking Horse Regulations in that it broke over the final 60 metres of the race.

The placings were : 10 – 12 – 9 – 1 – 5 – 6.

Presenting his evidence, stipendiary steward Mr Ydgren referred to the video of the finish of the race.  He showed that ARABESS (C Ford) galloped in the straight in excess of 50 metres – the stewards considered it at least 55 metres – which was a breach of Rule 870 (3) and the Breaking Horse Regulations.

In response, Mr Ford, representing the connections, confirmed he was familiar with the Regulations.  He said that he thought it may have been marginal and, after viewing the video, he acknowledged that, if it were in excess of 50 metres, it was close to it.  He also said his horse was well clear of the other horses at the finish.

DECISION
Given the time delay in hearing this protest, a brief decision was given and the parties were advised that a full decision would be available later.

This protest related to an alleged breach of Rule 870 (3) and the Breaking Horse Regulations by horse no. 1, ARABESS, which was placed 4th in the event.

Following the evidence, including the video of the run home, we find that ARABESS broke free of interference in the straight and continued in a gallop for about 55 metres in the run home.  Although it regained its gait just short of the line to finish in 4th place, we are satisfied, in galloping in excess of 50 metres, it did not promptly regain its gait and is thus in breach of Rule 870 (3) and the Breaking Horse Regulations.

Accordingly the protest is upheld and, in exercising our discretion, ARABESS is relegated to 5th place.
