Following the running of race 1, the Wild Tomato Trot, a protest was lodged by the stipendiary stewards against horses no. 10, BECKY (A Tomlinson) and no. 12, XENON (M P Edmonds) placed 1st and 2nd respectively, on the grounds of interference around the final bend to horse no. 7, UGLY BETTY (D Anderson).

Following the running of race 1, the Wild Tomato Trot, a protest was lodged by the stipendiary stewards against horses no. 10, BECKY (A Tomlinson) and no. 12, XENON (M P Edmonds) placed 1st and 2nd respectively, on the grounds of interference around the final bend to horse no. 7, UGLY BETTY (D Anderson).

The placings were : 10 – 12 – 9 – 1 – 5 – 6.

As the hearing commenced, the stewards sought leave to withdraw the protest against horse no. 12, XENON.  The information was so amended.

--

Introducing his evidence, stipendiary steward Mr Renault said that, around the final bend, Mr Anderson’s horse, the favourite UGLY BETTY, had galloped and they contend it was a result of Ms Tomlinson striking the wheel of the leader, ARABESS, which in turn caused Mr Edmonds (XENON) to move out sharply, checking UGLY BETTY.

Mr Edmonds gave his account.  He said that, turning for home, the horse he was following – Ms Tomlinson on BECKY – just touched the wheel in front and put in a few rough ones.  He moved out ‘pretty quick’ to miss her because he thought she might wipe him out at the time and, at the same time, Mr Anderson (UGLY BETTY) just touched his outside wheel.

Mr Renault then invited fellow steward Mr Ydgren, who was at the top of the straight, to interpret the video of the incident.  He identified the parties concerned and their respective positions and said that Ms Tomlinson appeared to strike the outside wheel of her stablemate in front, ARABESS.  She went a bit rough and Mr Edmonds, who was trailing her, had no option but to shift out, fearing he was going to have a breaker come back on to him.  Mr Anderson’s horse struck the wheel of Mr Edmonds, and he was checked into a gallop.

Mr Anderson endorsed this summary and added that the line of horses in front moved sideways, and he was two strides into making a run when it happened.

Ms Tomlinson was then asked for her account.  She said she was going to come out on the turn and her horse (BECKY) was hitting her foot.  She had to move her foot out of the stirrup but the horse just clipped it and, although she didn’t canter, she just went a bit rough or checked herself.  She said that Clint’s horse (Mr Ford on ARABESS) wasn’t going forward when she challenged.

Asked to comment on the report that she may have hit Mr Ford’s wheel, Ms Tomlinson said that although she may have gone close, she did not think she had and the reason her horse went a bit rough – she didn’t break, just slightly checked herself – was because it was hitting her foot.  She said she did hear a noise, but thought that was behind her.  She said, and the video confirmed, that she looked around at the time.

To the chair, Mr Edmonds said he saw Ms Tomlinson putting her foot up on the stay to get it out of the way, and he did hear a noise but he thought it was Mr Anderson hitting his wheel.

DECISION
Given the time constraints, a brief decision was given and the parties were advised that a full decision would be provided at a later time.

--

This was a protest lodged by the stipendiary stewards against horse no. 10, BECKY (A Tomlinson) placed 1st by the judge, on the grounds of causing interference to horse no. 7, UGLY BETTY, on the final bend.

Evidence was provided that BECKY was trailing the leader, ARABESS, with XENON (M Edmonds) and UGLY BETTY (D Anderson) in behind.  We accept, and there is no dispute that, on the final bend as she came out to challenge, BECKY went ‘a bit rough’ for a stride and, shortly thereafter, UGLY BETTY galloped and lost its chance in the race.

The purpose of the hearing is to establish if interference occurred.

--

Ms Tomlinson said her horse went rough or ‘checked herself’ – it did not gallop – because the horse was hitting her foot and she had to move her foot from the stay.  This action was confirmed by the trailing Mr Edmonds who, seeing this and anticipating a breaking horse in front, moved out wider sharply, resulting in UGLY BETTY touching Mr Edmonds’ wheel and breaking.  We note that, after its brief check, BECKY continued to trot to the finish of the race.

In making its decision, the committee accepts there was some movement and/or some factors that may have contributed to the breaking of UGLY BETTY.  However, we are not satisfied to the required standard that this alleged interference was totally attributable to the actions of BECKY and Ms Tomlinson.

--

Accordingly, the protest is dismissed and the placings remain :
