The protest was not contested by Mr de Fillipi and thus the protest was upheld accordingly.

Facts:

When "Two Wishes" driven by Mr Colin de Fillipi,  crossed the finishing line it had broken from its gait. It had galloped for approximately 30 metres before the post.

Submissions for Decision:

"Two Wishes" was clearly not in its correct gait when it crossed the finishing line. It was lapped on by "Seeker Dhu". Mr Ydgren submitted that "Two Wishes" should be relegated behind "Seeker Dhu".

Reasons for Decision:

"Two Wishes" was not in its correct gait and was therefore in breach of Rule 870(5).
