The protest was upheld and WAIPAWA JUNIOR was disqualified from the race.
Consequent upon the disqualification, the amended result for the race is as follows:
1st 3 Soak It Up
2nd 1 Night of the Stars
3rd 4 Southwind Arden
4th 6 Jellignite
5th11 Storm’s Rule
It was ordered that dividends and stakes be paid in accordance with the amended result.
Facts:
Following the running of Race 5, The Marque Hotel Christchurch Graduation Series (Final) Mobile Pace, an information instigating a protest was filed by Stipendiary Steward, Mrs K R Williams against WAIPAWA JUNIOR (R T May), placed 5th by the judge, on the ground that the horse “shifted inside pylons in excess of 30 metres in the run home”.
Mr G R Dunn, trainer of WAIPAWA JUNIOR, had signed the Statement by the Defendant on the information form indicating that he did not contest the protest.
Rule 869 provides as follows:
(7B) Where any horse or its sulky wheel moves inside the track marker line for more than 30 metres in the last 600 metres of a race the horse shall be disqualified from that race except where it is established that the breach was caused by interference by another horse or horseman
Submissions for Decision:
Mrs Williams showed video replays of the final 300 metres of the race. She pointed out WAIPAWA JUNIOR racing 3-back on the marker line following STORM’S RULE (R J Butt). The latter horse had full access to the passing lane. Mr May then entered the passing lane which, Mrs Williams submitted, was a risky manoeuvre as he had been 3-back, and not trailing. His sulky wheel stuck the first pylon and went inside the next pylon, coming back outside the track marker line “three-quarters of the way” to the next pylon. The pylons were 21 metres apart, Mrs Williams said. On that basis, Mrs Williams submitted that the total distance involved was approximately 38 metres.
Mrs Williams pointed out that the connections of WAIPAWA JUNIOR had seen all angles of the video replays and did not wish to contest the protest. She sought disqualification of WAIPAWA JUNIOR.
Reasons for Decision:
The Committee was satisfied from having viewed the video replays that the sulky wheel of WAIPAWA JUNIOR had moved inside the track marker line for more than 30 metres in the final 600 metres of the race. The Committee also noted that the connections of the horse did not contest the protest. The Rule requires that the horse be disqualified from the race.
