Charge:
Following race 6, an information was filed pursuant to Rule 856(2). The informant, Mr B Van Kan alleged that Mr B Purdon presented LOS AMANTE without the notified removable deafeners.
Facts:
Mr Van Kan informed the committee that Mr Purdon presented the horse into the birdcage without the notified gear.
Mr Z Butcher, representing Mr B Purdon, admitted the horse was presented in the birdcage without the correct gear. He said as soon as the Stewards had highlighted the error, the stable staff applied the correct gear on LOS AMANTE.
Submissions for Penalty:
Mr Van Kan submitted a $100 fine was appropriate
Mr Butcher submitted that he believed $100 was appropriate.
Reasons for Penalty:
The committee carefully considered all the evidence and submissions presented. The mitigating fact was Mr Butcher's admission of the breach. The trainer penalty report which we viewed showed this was Mr Purdon's 5th breach in the last 12 months. The latest fine imposed was $125, therefore we explained to Mr Butcher a small increase is warranted.
