Decision: An Information was lodged by Stipendiary Steward Mr T TAUMANU alleging that horseman C WEBBER used his whip excessively on LUCY LYNNE during the run home in Race 3

An Information was lodged by Stipendiary Steward Mr T TAUMANU alleging that horseman C WEBBER used his whip excessively on LUCY LYNNE during the run home in Race 3. Mr WEBBER admitted the charge and was present for the hearing.

Mr Taumanu in referring to video footage of the concluding stages of the race showed Mr WEBBER whipping his horse in an energetic deliberate and unabated manner throughout the run home striking the horse 16 to 18 times.

Mr Webber in response admitted his use of the whip was a little bit excessive but said he was trying to get the best out of the horse which he owned. Finishing in third place he believed he had a good chance of improving his placing and drove the horse accordingly.

In Submissions on penalty Mr Taumanu said the starting point for this type of offence was normally $250 but taking into account Mr Webber had recently returned to driving after an extended absence, his clear driving record and his admission of the breach suggested a fine of $200 was appropriate.

Mr Webber agreed with a fine but thought that $200 was excessive.He had  approximately 20 drives for the season.

Taking into account all matters provided during the hearing particularly Mr Webbers good driving record and his admission of liability  I agree with Mr Taumanus submissions on penalty and  subsequently fine Mr Webber $200.00
