--Horse 9 BLAZING BLUE carelessly
| -- An information was lodged by Stipendiary Steward Mr T Taumanu alleging that driver N Thorn drove Horse 9 BLAZING BLUE carelessly when improving into a gap between Debbies Deluxe ( A Pyers) and Four Leg Drive ( R Downey) where there was insufficient room, resulting in BLAZING BLUE galloping with approximately 100 metres to run. ----Miss Thorn denied the breach and was present for the hearing. ----Stipendiary Steward Mr Taumanu gave evidence whilst referring to Video tapes of the home run. ----His evidence supported by the tapes was that Miss Thorn tried to improve into a gap through which there --was clearly insufficient room to negotiate without causing interference with either Four Leg Drive --or Debbies Deluxe. He said that Miss Thorn was an experienced horsewoman who had anticipated a gap that did not occur which resulted in her drive breaking up and losing all chance in the race. ----Miss Thorn had no questions arising from Mr Taumanu's evidence. ----In her defence and in referring to the video she contended that her driving was not careless and that she had entered the gap intending to improve but had pulled back but the horse had not listened. She said that she had a responsibility to do the best for her drive and did not consider her drive had been careless. In response to questioning she conceded that her horse had broken as a result of the manoeuvre. She agreed that she has a responsibility to drive carefully and that she had anticipated a gap which did not eventuate but that the horse did not respond when she elected not to pursue further through the gap. ----Decision ----The evidence given by both parties clearly showed there had been carelessness in Miss Thorns driving which had resulted in Blazing Blue galloping. Video evidence supported the Stipendiary Steward Mr Taumanus contention and the charge was established ----Following submisions on Penalty a fine of $300 was imposed |
