Following the running of Race 8, the John Villiger Memorial Junior Drivers Mobile Pace, David Branch, the driver of NO FUSS POPLAR, was charged with a breach of Rule 870 (1) (2) (a). It was alleged that Mr Branch 'failed to immediately take his horse clear of the field when clearance existed

Following the running of Race 8, the John Villiger Memorial Junior Drivers Mobile Pace, David Branch, the driver of NO FUSS POPLAR, was charged with a breach of Rule 870 (1) (2) (a). It was alleged that Mr Branch 'failed to immediately take his horse clear of the field when clearance existed with approximately 500m left to run, causing a check to SAMARAMA, driven by R Downey, which tangled for a few strides'.
--Mr Branch, who was assisted by Mr Murray Branch, admitted the breach.
--Prior to making his submissions on penalty Stipendiary Steward Mr Taumanu demonstrated the incident by way of the films of the race. These showed NO FUSS POPLAR break its stride with approximately 500m to run, when racing in the one out one back position, and Mr Branch fail to move it wider on the track as required. The films also demonstrated SAMARAMA being inconvenienced by NO FUSS POPLAR maintaining the position that it did.
--Mr Murray Branch commented on the incident by stating that the checking of SAMARAMA was largely of its own doing and as such little weight should be placed on the consequences of the breach.
--When making his penalty submissions Mr Taumanu commenced by advising the committee that Mr Branch had never previously faced a charge and therefore his records was clear. It was his recommendation that a suspension be imposed and that this should be one of two days.
--Mr Murray Branch, when addressing the committee, acknowledged that there had been a breach of the rule however submitted that a penalty of a one day suspension was more appropriate.
--PENALTY
--After carefully considering the submissions made it is the committee's finding that the appropriate penalty, in this case, is a period of suspension. In determining the quantum to be imposed the committee has given credit for the admission of the breach and it has also recognised that Mr Branch has had very limited race night experience, being that he is only starting out in his driving career.
--The committee also accepts the argument that the inconvenience caused to SAMARAMA was, to a degree, of its own making and as such little weight is placed on the consequences of the breach but rather the committee has looked at the breach in isolation.
--Mr Branch has outlined his upcoming driving schedule and after due consideration it is the committee's finding that the suspension imposed should be one of 2 days, and accordingly Mr Branch is suspended from the conclusion of racing tonight up to and including racing on Friday 26th October 2007.
