Decision:

An Information instigating a protest was lodged by Stipendiary Steward Mr T Taumanu following the running of Race 4, The John Villiger Memorial Junior Drivers Mobile Pace.

It alleged Horse 12  LAST SAY (Junior Driver S Jones), placed 2nd by the judge, interfered with other runners during the final stages of the race.

Mr K Smith, Trainer, was present and contested the protest.  Mr Jones was supported by Senior Horseman Mr B Hackett.

Mr Taumanu referred to video footage of the concluding stages of the race.  LAST SAY had turned for home at the head of the field.

He identified LAST SAY with 14 BETTORS STAR, 2 THREES A CROWD, 5 MANOTICK EXPRESS, 1 ULTIMATE BROMAC, 4 VILLAGE SARTI and 8 FALCONS FAIR progressively on its outside.

LAST SAY deviated outwards in the run home which had a concertina effect on the horses outside.  FALCONS FAIR broke after inside horses were forced wider.  LAST SAY was straightened and finished second behind  DRIVING RAIN.

Mr Jones said his horse ran out before he took it under control and pulled it back down.  His horse ran home easily for second and he had taken all permissible steps to get the horse under control and stop her going any wider.

Mr Hackett on behalf of Mr Jones said Mr Jones did try and straighten the horse up.  He admitted Mr Jones had caused interference but said that the outside horse FALCONS FAIR should not have galloped..  There was interference on the horses immediately outside of LAST SAY.

Mr Taumanu said the two horses immediately outside LAST SAY had been affected by the interference and asked for LAST SAY to be relegated behind those runners into fourth place.

Trainer Mr Smith suggested the place margins did not warrant his horse being relegated.

DECISION

I am satisfied that LAST SAY has caused interference to other horses during the concluding stages of the run home by forcing other runners wide and affecting their chances.  LAST SAY has gained an advantage over other challengers and accordingly is relegated to fourth place.
