Mr Taumanu asked that footage shown at the earlier Protest Hearing into the same race be accepted by all parties.

He said the Mr Jones drive LAST SAY had forced other runners wider on the track during the run home which had clearly affected their progress and chances of finishing in a better position. In his opinion the breach was clearly at the lower end of the scale and suggested a fine of $300 was appropriate. Mr Jones had admitted the breach.

Mr Fergusson on Mr Jones behalf agreed the requested penalty was fair and that any thought of suspension would be excessive.

Taking these matters into account I agree with Mr Taumanu's recommendation and impose a fine of $300.
