Decision:
An Information instigating a protest was lodged by Stipendiary Stewards TW Taumanu and JM Muirhead against the second placing of horse number 8 Freestyler (Driver S Reid) on the grounds that it’s Driver S Reid failed to start from the correct barrier position. Freestyler started from the vacant mobile barrier position of number 7 instead of its drawn barrier position of number 8.

--Rule 862(2) provides:
--“No Horseman shall permit a horse to start and no horse shall start other than from its correct barrier position (either at a standing or mobile start) unless directed by the Starter in accordance with Rule 860(8).”.
--Mr Reid was present and he advised this Committee that he was representing the connections of Freestyler and he did not contest the protest. Mr Reid also acknowledged that he understood the provisions of Rule 862(2).
--Evidence was given by use of the video films and this showed that in the run up behind the mobile barrier horse 7 Alta Onassis had broken and had lost its chance and accordingly barrier 7 was vacant. Mr Reid moved Freestyler from barrier 8 into barrier 7 in the run up and was in barrier 7 at the dispatch of the Mobile Gate.
--DECISION
--On the basis that this protest is not contested the Committee disqualifies Freestyler from the race and the amended placings are now:
--1st 5 (Aceman)
2nd 4 (Bobby Lashley)
3rd 3 (Regal Eagle)
4th 2 (Jewels Bound)
5th 1 (Emerald Dream)
6th 6 (Marlon Brando)
