An Information was lodged by assistant Stipendiary Steward Mr S Wallis alleging that Horseman Mr A Pyers failed to bring his horse Mazza D up to the correct position on the mobile gate in barrier one and eventually starting the race approximately one and a half lengths off the mobile gate.

An Information was lodged by assistant Stipendiary Steward Mr S Wallis alleging that Horseman Mr A Pyers failed to bring his horse Mazza D up to the correct position on the mobile gate in barrier one and eventually starting the race approximately one and a half lengths off the mobile gate.
--Mr Pyers admitted the charge and was present at the Hearing.
--Rule 857(7)(g) provides:
--“No Horseman shall fail to come up into and/or maintain his position.”.
--Mr Wallis gave evidence that he was watching the race from the Steward’s Patrol Box at the 200 metre mark and he observed Mr Pyers hanging back at the start. He said that Mr Pyers made no effort to get his horse up into position at the start and pointed out that Mr Pyers had drawn barrier one.
--Mr Wallis then showed the film of the incident and the position of Mazza D was pointed out to this Committee. Mr Wallis said that the film showed that Mr Pyers was not having any difficulty with his horse and in fact he appeared to be holding it back. Mr Wallis said that Mr Pyers had told him that he was holding the horse back trying to get a flying start.
--Mr Wallis’s opinion was that Mr Pyers not only did not get a flying start but rather that he had lost his position by failing to keep up with the mobile barrier.
--Mr Pyers for his part confirmed that Mr Wallis’s evidence was basically true. He said that he tried to get a flying start with his horse but his plans came unstuck and that was just one of those things. He said that he missed the gate altogether and he can’t do anything about it.
--Mr Pyers also suggested that his horse did not have great gate speed and when he saw how the other horses flew out of the barrier that he believed that he would still have ended up in the same position in any event.
--PENALTY
--Mr Wallis referred to the JCA Guidelines which recommend a fine of $250.00 and said that that was the penalty he was looking for.
--Mr Pyers for his part thought that $250.00 was excessive.
DECISION
--Mr Pyers has pleaded guilty to the charge and accordingly it is proven. The evidence shows that this was a particularly poor effort on the part of Mr Pyers and that his horse lost any advantage it had from drawing one at the barrier.
--In deciding upon penalty this Committee takes into account the submissions made by both Mr Wallis and Mr Pyers and also takes note of the penalty recommended in the JCA Guidelines of $250.00. Mr Pyers is however given credit for his good driving record over the last 12 months and also for the fact that he has pleaded guilty.
--This Committee therefore fines Mr Pyers the sum of $200.00.
