An Information instigating a protest was lodged by Stipendiary Steward Mr JM Muirhead against the third placing of horse number 3 Nicolas Breakspear (Driver S Reid) on the grounds of breaking free of interference and galloping in excess of 50 metres within the last 100 metres of the race.

--Part owner Mr GA Rogerson represented the owners of Nicolas Breakspear and did not contest the protest.
--Stipendiary Steward Mr JM Muirhead demonstrated the incident by use of the video film. He showed where Nicolas Breakspear had progressed around the field and went into a break in the last 100 metres. Mr Muirhead estimated that Nicolas Breakspear galloped for approximately 90 metres and clearly it was at least 80 metres.
--DECISION
--On the basis that this protest was not contested the Committee upholds the protest and pursuant to the provisions of Rule 870 and the Breaking Horse Regulations Nicolas Breakspear is disqualified from the race.
--The amended placings are now:
--1st 1 (Swift Therapy)
2nd 10 (Unsolved)
3rd 2 (Haylin Hurricane)
4th 6 (Phil B)
5th 4 (Waingaro Emperor)
6th 9 (Captain Marcus)
