Decision:

A protest was lodged by Stipendiary Steward Mr J MUIRHEAD following the running of Race 5.

A protest was lodged by Stipendiary Steward Mr J MUIRHEAD following the running of Race 5.

The Information was laid on behalf of the connections of Horse 10 SPECIALIAM (Junior Driver M WHITE),placed 3^rd by the Judge against Horse 13 NACOKEE (Driver R BROSNAN), placed 2^nd by the Judge, alleging interference occurred inside the last metres of the race.

Mr BROSNAN appeared for the connections of NACOKEE and contested the Protest.

Mr White and Trainer Mr M BERGER appeared in support of SPECIALIAM.

Mr White gave evidence of the run home of his position 2 off the rail and Mr Berger on his outside. Initially there was plenty of room but Mr Brosnan had kept coming in on him and he had to stop driving in the latter stages of the race.

When questioned by Mr Muirhead, Mr White was adamant that with a half head margin between 2^nd and 3^rd his chances had been affected

He maintained a virtually straight line to the finish and although the inside horse had possibly moved out slightly in the concluding stages the outside pressure from Mr Brosnan had affected his chances.

Mr Berger had no comments other than to support the evidence given by Mr White.

Mr Muirhead with reference to the video tapes of the concluding stages of the race indicated where Mr Brosnan had drifted in over the final 200 metres of the race with his sulky wheel crossing inside Mr White's line on two occasions. The inside horse had come out marginally but Mr White was concerned about Mr Brosnan on his outside. Mr Brosnan was obliged to keep his horse travelling straight and if he done so there would have been plenty of room.

In the concluding stages Mr Brosnan was slightly infront of Mr White as Specialiam was trying to improve and Mr Muirhead suggested that even at that stage had Mr Brosnan straightened Mr White could have driven out rather than being forced to stop driving

Mr Brosnan in his evidence said that the winning horse on the rails had come out slightly just before the finish at the point that Mr White had stopped driving .He maintained that he had kept a pretty straight line and that Mr White had drifted out slightly.

He said that if Mr White had been inconvenienced by him he could have pulled off him and headed Mr Brosnan.

When questioned by Mr Muirhead Mr Brosnan said he was not aware that his wheel had come inside Mr White's line and on viewing the tapes was still not satisfied this had happened.

Decision

I am satisfied that there has been interference caused by Horse 13 NACOKEE and that this interference on SPECIALIAM had affected his chances. In the concluding stages Mr Brosnans drive had moved in 1 to 11/2 sulky widths and this had prevented Mr White from driving out the concluding stage of the race.

Following the Stipendiary Stewards recommendation NACOKEE is relegated 3^rd place and SPECIALIAM is promoted to 2^nd place.

1^ST 6 IWI FAWKES

2^ND 10 SPECIALIAM

3^RD 13 NACOKEE

4^TH 11 DARTH INVADER

5^TH 3 SPRINGFIELD ALLISON

6^TH 12 IDLE WISE.
