Following the running of race 8, Stipendiary Steward Mr J MUIRHEAD laid an information lodging a protest against Horse 11 TUFFERY (P FERGUSSON) placed first by the Judge.
Following the running of race 8, Stipendiary Steward Mr J MUIRHEAD laid an information lodging a protest against Horse 11 TUFFERY (P FERGUSSON) placed first by the Judge.
----The Information was laid on behalf of horse 15 SHERAKIN STAR (T Grayling, 2nd), horse 7 DAIBIN (B Mangos 3rd) and horse 4 JUSTIN MORRIS (M McKendry 4th) and alleged that TUFFERY broke from its gait with approximately 30 metres to run and crossed the finish line being lapped on by the horses subsequently placed 2nd 3rd and 4th by the Judge.
----Mr S PHILLIPS (part owner) and Mr P FERGUSSON appeared for the connections of TUFFERY and did not contest the Protest.
----Mr MUIRHEAD gave evidence and referred to video footage of the concluding stages of Race 8 which clearly showed TUFFERY to break short of the line and continue across, being lapped on by Sherakin Star Daibin and Justin Morris consecutively. Mr Muirhead sought relegation of TUFFERY from 1st to 4th.
----DECISION
----It is clear that TUFFERY broke from its gait short of the finish line and continued past the post before recovering and that upon crossing the finish line it was lapped on by the 2nd 3rd and fourth placed horses.
----TUFFERY is relegated to 4th place and the Judges placings are amended as follows
--1st 15 SHERAKIN STAR 2nd 7 DAIBIN
--3rd 4 JUSTIN MORRIS 4th 11 TUFFERY
--5th 5 EYESLOOKINGATYOU 6th 9 LOTTA SOUL
