An Information was lodged by Deputy Stipendiary Steward Mr SW Wallis alleging that Trainers SJ Reid and G Rogerson failed to ensure that the Removable Hood on the horse Lord Patrol was properly affixed so as not to malfunction.

Mr K Laidlaw as the person in charge of Lord Patrol on race night admitted the charge but advised this Committee that he wished to be present at the Hearing.

--

Mr Laidlaw was also joined by Mr R Lawson at the Hearing with Mr Lawson telling this Committee that he was representing the Reid/Rogerson stable.   This Committee was aware that Mr Rogerson was on course and queried Mr Lawson’s presence at the Hearing.   The Stipendiary Stewards were happy to proceed on the basis that the charge had been admitted.

Stipendiary Steward Mr TW Taumanu demonstrated the incident to the Committee by way of video film and also produced the record relating to the Reid/Rogerson stable.   This report showed that the Reid/Rogerson partnership had four previous offences under this particular Rule in the last 10 months, two of those relating to the malfunction of Ear Hoods.

Mr Lawson was given the opportunity to comment on this report and he suggested to this Committee that the stable had not committed any breaches of this Rule for the last 12 months although the report discloses a different situation.   Mr Lawson also told this Committee that the Reid/Rogerson training partnership is the busiest training partnership in the North Island and has had the most starters this season and because of the number of starters then occasionally mistakes may happen although the Trainers endeavour not to make any such mistakes.

Decision and Penalty

--

The charge having been admitted therefore it is proven.   In deciding on penalty this Committee had the recommendation of a fine of $100.00 from the Stipendiary Stewards and against this Mr Lawson had relied on the number of starters that the Reid/Rogerson stable has and that fact that mistakes might occasionally happen.   He also told this Committee that no other horse was affected.

This Committee viewed the JCA Penalty Guide which provides for a fine of $250.00.   The Committee is also mindful of the fact that this is the fifth charge against the Reid/Rogerson partnership under the same Rule in the last 10 months.   The Committee notes the Stipendiary Steward’s recommendation of a $100.00 fine but in this instance believes that the fine should be higher and accordingly imposes a fine of $150.00.
