Facts:
Following the running of Race 6, the Floorpride Rangiora Pace, an Information Instigating a Protest was filed by Stipendiary Steward Mr N. G. McIntyre alleging interference by “Arden Torres” (13), driven by Mr M. Purdon, to “Cantthinkofaname” (4), driven by Mr M. P. Jones, and “Democracy” (12), driven by Mr N. R. McGrath.
The Judge’s placings in this race were as follows.

The Information reads as follows.
This is a protest by horses number (4) and (12) against horse number (13) placed 3rd by the Judge on the grounds of interference (Rule 869(8)) – Shortly after start ARDEN TORRES jumped and broke checking Cantthinkofaname and Democracy.”
Rule 869(8) provides as follows.
“The Judicial Committee may in addition to any other penalty which may be imposed pursuant to Rule 1003 thereof place any horse which:
(a) may have gained an advantage by any conduct or interference prohibited by any preceding provision of this Rule and/or
(b) may have interfered with, or whose horseman may have interfered with, the progress or chance of any other horse or horses, -
immediately after any horse from which it may have gained an advantage or whose chances or progress may have been affected thereby.”
The connections of “Arden Torres” did not attend this hearing, but Mr M. Purdon, the trainer and driver of that horse, had endorsed on the information – “The connections do not contest the protest”.

Stipendiary Steward Mr McIntyre used video coverage of this incident to show that shortly after the start “Arden Torres” had jumped inwards causing interference to “Cantthinkofaname” and “Democracy”, with both horses being severely affected, and “Cantthinkofaname” finishing last of the 15 starters.
Mr McIntyre submitted that “Arden Torres” should be relegated to last place.
Reasons for Decision:
After hearing the evidence, and taking into account that the protest was not contested, we decided that “Arden Torres” should be relegated to last (15th) place.
