Following the running of race 3 an information was lodged by the Stipendiary Stewards against Mr McGrath, the driver of STRAWBS POSH DREAM, alleging that he used the whip excessively in the home straight.

The Stipendiary Stewards advised the Committee that Mr McGrath had indicated earlier that he was to defend the charge but later decided to admit the breach and the information was amended accordingly and initialled.

At the outset of the hearing the Committee noted that the charge filed was under rule 869 (2) (b) whereas it should be under rule 869 (2) (a). With the consent of both parties the information was accordingly amended.

Mr Ydgren showed the run home and the drive of Mr McGrath and said in his view Mr McGrath struck the horse or cart continuously for approximately 200 metres and he counted about 23 hits with the whip. The charge is accordingly found proven.

In respect of penalty Mr Ydgren submitted that a monetary penalty in the normal range should be applied and that Mr McGrath should be given credit for the clear record over the last 12 months in respect of any breaches of this rule.

Mr McGrath said that he continued to hit the horse as it was running on and he stopped hitting the horse short of the line when it ran clearly in third position.

The Committee after taking into account the submissions of the Stipendiary Stewards and Mr McGrath is of the view that a monetary fine is sufficient on this occasion and after giving credit for Mr McGrath’s previous good record a fine of $200.00 is imposed.
