FACTS:
--Following the running of Race 1, Hornby Working Men’s Club Pace, an information instigating a protest was filed by Stipendiary Steward, Mr N M Ydgren, against DUNARUNNER (R J Butt), placed 4th by the judge, on the ground of interference to SPECIAL CULLEN (C J Markham), placed 15th by the judge, with approximately 750 metres to run.

Mr Butt was present at the hearing of the information and he informed the Committee that he was authorised to represent the connections of DUNARUNNER. He was assisted at the hearing by Mr Jones.
----
Rule 869 provides as follows:
--(8) The Judicial Committee may in addition to any other penalty which may be imposed pursuant to Rule 1003 thereof place any horse which:
--(a) may have gained an advantage by any conduct or interference prohibited by any preceding provision of this Rule and/or
--(b) may have interfered with, or whose horseman may have interfered with, the progress or chance of any other horse or horses-
--immediately after any horse from which it may have gained an advantage or whose chances or progress may have been affected thereby.

SUBMISSION(S):
--Mr Ydgren stated that it was alleged that Mr Markham on SPECIAL CULLEN had pushed out Mr Butt on DUNARUNNER with approximately 750 metres to run. As a consequence, Mr Markham was left in a gap between Mr Butt on his outside and another runner on his inside. He was then “squeezed into a gallop”, Mr Ydgren said.

Mr Markham stated that he had attempted to push Mr Butt out 4-wide and he believed that he had done so. He said that he was fully out into the 3-wide line alongside LIFE’S EXCITING (K M Barron) on his inner. Mr Butt then came in on him, Mr Markham said. He ran out of room and his horse broke and lost all chance.

Mr Markham said that his horse had been travelling well prior to the incident but, after it, it “lost all interest”.

Mrs K R Williams, Stipendiary Steward, showed head-on and side-on video replays of the incident and pointed out the runners involved.

Mr Jones, on behalf of Mr Butt, submitted that Mr Butt had always been in front of Mr Markham and, therefore, Mr Markham was not entitled to push him out. He referred to the side-on video replay to illustrate this. Mr Jones said that Mr Markham had put himself in that position. Mr Butt had held his line on the back of COSMIC DREAM, driven by Mr Jones, in the 3-wide line. Finally, Mr Jones submitted that Mr Butt had not been moved 4-wide at any stage.

Mr Butt did not wish to add to what Mr Jones had said on his behalf.

Mr Ydgren, when asked by the Committee, agreed that it could not be said, having seen the head-on video replay, that the interference to SPECIAL CULLEN could be attributed to Mr Butt. He expressed the view that the breaking of that runner may have been the result of “general tightening”.

REASON(S):
--The Committee was not satisfied that interference had been caused to SPECIAL CULLEN by DUNARUNNER. The video evidence did not support Mr Markham’s evidence that Mr Butt had come in on him. Mr Markham had attempted to move out from the one-out line to 3-wide by easing Mr Butt. The Committee was not satisfied that he was entitled to do so as it appeared that he did not hold an advantage over Butt. Mr Butt was established in the 3-wide line and remained there. When he was unable to ease out into the 3-wide line, Mr Markham appeared to be in a space between the one-out and 3-wide lines and was tightened resulting in his horse breaking. The Committee agreed with Mr Ydgren that it was a racing incident with the blame not being able to be attached to any one horse or horseman.

DECISION:
--The protest was dismissed and the judge’s placings stand.
