At the meeting held on 29 March 2009 an information was lodged by the Stipendiary Stewards alleging a breach of the Notification of Drivers Regulations in that R J Lattimer failed to declare a driver for B Sharp by the official notification time which was 1.00 p.m. on Thursday 26 March 2009.
--At the outset of the hearing the Committee noted that Mr Lattimer admitted the breach and did not wish to be heard.
--Mr McIntyre, for the informant said that the Stipendiary Stewards had received advice from the Secretary of the Club but no notification of a driver by Mr Lattimer in respect of B Sharp for race 4 had been made by the required time, and, accordingly, the regulation had been breached.
--The Committee finds the charge proven. Mr McIntyre advised the Committee that Mr Lattimer had no previous breaches of the regulation during the preceding twelve months and recommended a monetary penalty.
--The Committee, after giving consideration to the Stipendiary Stewards view as to penalty, imposes a fine of $50.00.
