DECISION AND REASONS:

Following the running of Race 4, the Mid Canterbury Trotting Owners Association Pace, an information was filed by Stipendiary Steward Mr N. G. McIntyre against Mr R. N. Needham, driver of “Time To Roll” (18), alleging a breach of Rule 869(3)(b). It was alleged that Mr Needham drove carelessly when striking the wheel of A. Laing’s horse Tarport Spirit causing his own horse to break and fall.

Mr Needham had indicated on the information that he admitted this breach of the Rules and he confirmed this at the hearing. Mr Needham also agreed that he understood the Rule and the charge.

Mr McIntyre used video coverage to illustrate this incident. In explanation Mr Needham said that his horse was racing keenly at the time, and was difficult to control. It was also established that this incident had no serious effect on Mr Needham or his horse, and also that the rest of the field was not affected.

Penalty:

In relation to penalty Mr McIntyre advised that Mr Needham had no relevant previous convictions and had admitted the breach. Mr McIntyre recommended a 2 – 3 day suspension.

Mr Needham informed us that he preferred a suspension to a fine, and that he had only one horse racing at the moment.
----
We were satisfied that a 3 day suspension was appropriate in this case. We advised the parties that Mr Needham’s Open Horseman’s Licence was suspended from after the completion of racing on 28 March 2010, until after the completion of racing on 13 April 2010. This period of suspension includes race meetings at Forbury Park on 1 April, Banks Peninsula on 11 April, and Timaru on 13 April 2010.
