Following the running of race 2 the Stipendiary Stewards lodged an information instigating a protest against horse no. 5 Good Looking Guy placed second by the Judge.

DECISION & REASON

Following the running of race 2 the Stipendiary Stewards lodged an information instigating a protest against horse no. 5 Good Looking Guy placed second by the Judge. The Judge's placings were first 4, second 5, third 12, fourth 2, fifth 6 and sixth 9.

The information alleged that Good Looking Guy broke with approximately 70 metres to run and only regained its gait just short of the warning post.

At the outset of the hearing Mr Keast confirmed that he had authority to act as the representative of the connections of the horse at the hearing.

Mr McIntyre then read out Rule 870 (3) and the Breaking Horse Regulations and, in particular, that "it shall be deemed to be a breach of the rule if the horse is out of its correct gait for more than 50 metres within the final

The video evidence of incident was shown to the Committee and the Stipendiary Stewards in particular asked the Committee to note the point of the track that the horse left its gait which was some 15 metres or more prior to the 50 metre post. The Stipendiary Stewards also pointed out the point at which the horse regained its proper gait which was just prior to the winning post.

Mr Keast, after viewing the video evidence, advised the Committee that the on behalf of the connections he acknowledged the breach of the rule. Mr McIntyre confirmed that they sought the disqualification of Good Looking Guy from the race.

In view of Mr Keast's admission in respect of the breach the protest is upheld and horse no. 5 (Good Looking Guy) is disqualified from the race. The amended placings are first 4, second 12, third 2, fourth 6, fifth 9, and sixth 10.
