As Mr Purvis had admitted this breach of the Rules it was found to be proved in accordance with Rule 1111(1)(d).
Penalty:
Mr Purvis’ Junior Drivers License was suspended from the conclusion of racing today 20 March up to and including 26 March 2016. This suspension encompasses the meetings at Dunedin on 24 March and Christchurch on 26 March 2016.
Facts:
Following the running of Race 5, the Speights Ale House Tower Junction Mobile Pace, an information was filed by Stipendiary Steward Mr S Renault against Junior Horseman Mr M Purvis, alleging a breach of Rule 869(3) (b) in that he drove carelessly passing the 1000m when allowing his horse to strike the sulky wheel of SHELLEY ANN causing his own horse to pace roughly.
Mr Purvis had indicated on the Information that this breach of the Rules was admitted which he confirmed at the hearing. He also confirmed that he understood the Rule he was being charged with.
Mr Purvis, as a Junior Driver, was assisted at the hearing by Open Horseman, Mr J Dunn.
Rule 869(3)(b) reads as follows:
“(3) No horseman in any race shall drive:-
(b) carelessly:-
Mr Renault gave evidence and used video coverage to show that SHANTAHLIA ROMEO, driven by Mr Purvis, was racing 4 back on the pylons approaching the 1000m. He said that Mr Purvis then shifted off the pylons to take up 1 off position behind SHELLEY ANN, driven by Mr J Markham, and became awkwardly placed between runners. He stated Mr Purvis allowed SHANTAHLIA ROMEO to get too close to the sulky wheel of SHELLEY ANN and as a result stuck the sulky wheel of that horse. This caused his horse, SHANTAHLIA ROMEO to go rough for several strides.
Mr Dunn stated that SHANTAHLIA ROMEO was known to charge forward in similar circumstances and submitted that the horse was difficult to drive. He stated that the carelessness and consequences were low end with only Mr Purvis’ own horse affected in this incident.
Mr Renault agreed that SHANTAHLIA ROMEO was a difficult horse to drive.
Submissions for Penalty:
Mr Renault informed the Committee that Mr Purvis had a clear record and had driven on 86 occasions so far this season with 134 drives last season. He said Mr Purvis had admitted the breach and that the carelessness and consequences of the breach was at the low end due to there being only his own horse affected. Mr Renault stated that the JCA Penalty Guideline starting point for a breach of this rule was a fine of $500 or 10 drive suspension. Mr Renault submitted that a fine of $250 to $300 be imposed as penalty in this case. Mr Purvis stated that as he was a Junior Driver, he would prefer a suspension as penalty. Mr Renault said the Stewards had no objection to a suspension and said Mr Purvis drove on approximately 2-3 occasions per meeting. He submitted that a 2-day suspension be considered as penalty if the Committee agreed that a suspension was appropriate.
Deferment of penalty was discussed with Mr Purvis opting to take any suspension immediately.
Reasons for Penalty:
In determining penalty, the Committee took into account Mr Purvis’ admission of the breach, his good record and his status as a Junior Driver. We also considered this breach to be low level and determined that a suspension would be an appropriate penalty in this case. In adopting a starting point of 10 drives we were able to give Mr Purvis a discount of 2 drives for his admission of the breach and a further discount of 4 drives for his good record, his status as a Junior Driver and the low level of the breach. We therefore determined that a 2-day suspension was an appropriate penalty in this case.
