Following the running of Race 1 a Protest was lodged by the Stipendiary Stewards in respect of the 5th placing being awarded to Sea Spray Darling (C Markham).

DECISION & REASON
--Following the running of Race 1 a Protest was lodged by the Stipendiary Stewards in respect of the 5th placing being awarded to Sea Spray Darling (C Markham). The information alleged that Sea Spray Darling broke with approximately 200 metres to run and failed to regain its gait by the finishing point.
----At the outset of the Hearing it was noted that Mr Markham, the trainer and driver of Sea Spray Darling had confirmed in writing that the protest was not contested.
----The Stipendiary Stewards showed the video evidence of the final 300 metres of the race. This clearly showed Sea Spray Darling leaving its correct gait with approximately 200 metres to run and remained out of its gait until after the finishing point. It was noted also that Mr Markham, the driver of the horse, was endeavouring to do all he could to restrain the horse and return it to its correct gait.
----The Stipendiary Stewards sought the disqualification of Sea Spray Darling under Rule 870(3) and the breaking horse regulations.
----The Committee finds that Sea Spray Darling did leave its correct gait at a point approximately 200 metres from the finishing point of the race and was still out of its gait at the finishing point.
----Seaspray Darling is therefore disqualified from the race. The amended placings reading
