Facts:
Following the running of Race 7, Papanui Club Junior Drivers Pace, an Information instigating a protest was filed by Stipendiary Steward, Mr SP Renault, against THE CROUPIER (SJ Tomlinson), placed 4th by the judge, on the ground that it “broke prior to and over the finish line and was lapped on” by MYBOYLOLLIEPOP (BA Laughton) and OUT OF ACES (AL Fitzgerald), placed 5th and 6th respectively by the judge.
Miss Tomlinson was not present at the hearing of the information, but she had endorsed and signed the information “I do not contest the protest”. This was confirmed by Mr Renault.
Rule 870 provides as follows:
(5) Notwithstanding the provisions of sub-rule (4) hereof any horse which is not in the correct gait when its nose reaches the finishing line which is lapped on by any other horse or horses in the correct gait shall be placed by the Judicial Committee behind such horse or horses provided that where such first mentioned horse is not in its correct gait as a result of interference to such horse or horseman, then (subject to Rule 869 (8) such relegation of the horse shall be at the discretion of the Judicial Committee.
The judge’s official placing were as follows:

Mr Renault showed video replays of the final 100 metres of the race. He pointed out THE CROUPIER, the widest runner on the track. He also pointed out the marker peg on the inside of the track indicating the distance 50 metres from the finishing line. Mr Renault said that the horse was in its correct gait passing the 50 metres but, shortly thereafter, at the 40 metres, it went into a gallop and continued in a gallop past the finishing line, finishing in 4th placing. It was lapped on by both the 5th placed runner, MYBOYLOLLIEPOP and the 6th placed runner, OUT OF ACES, Mr Renault said.
Mr Renault produced the official photo finish of the race. Miss Tomlinson had told Stewards that the horse had galloped as a result of striking a knee, Mr Renault said.

The Committee was satisfied that THE CROUPIER was in its correct gait when it passed the 50 metres. At approximately the 40 metres, it went into a gallop, free of interference, and continued on in a gallop until after the finishing line and that it was lapped on by both the 5th and 6th placed runners. The Committee also noted that Miss Tomlinson did not contest the protest. The Rule requires that THE CROUPIER be relegated behind the 5th and 6th placed runners.
