Following the running of Race 3 an information was lodged by the Stipendiary Stewards alleging that J P Walkinshaw (Hunters Gold) failed to ensure his horse started from or maintained its position behind the mobile gate.

Following the running of Race 3 an information was lodged by the Stipendiary Stewards alleging that J P Walkinshaw (Hunters Gold) failed to ensure his horse started from or maintained its position behind the mobile gate.

At the outset of the hearing Mr Walkinshaw confirmed that the breach was admitted.

The Stipendiary Stewards showed the video evidence of the start of the race and asked the Committee to note that Mr Walkinshaw's horse was drawn three but at all times prior to the start was at least one or more lengths back from its correct position. The Committee was also asked to note that the horses starting from the second line had no option but to start from the third line and this inconvenienced their start.

With respect to penalty Mrs Williams advised the Committee that the Stipendiary Stewards viewed this as more serious than the normal situation where a $100 fine had recently been imposed and sought a monetary penalty in excess of that amount.

Mr Walkinshaw for his part said that he had had difficulty with the horse but accepted the Stipendiary Stewards view that, in terms of the rules, it was his obligation alone to ensure that the horse started from the correct position. He agreed that a monetary penalty was appropriate.

With regard to penalty, after considering the matters referred to by the Stipendiary Stewards and Mr Walkinshaw's submissions, the Committee is of the view that a fine is appropriate and, accordingly, a fine of $200 is imposed.
