Facts:
Following the running of Race 5, the Tara Family Trust Handicap Trot, an Information was filed by Stipendiary Steward, Mr S Renault, against Open Driver, Mr R May, alleging that “R May (BELMONT’S GREATEST) shifted inwards in the early stages of the run home and protruded inside the marker line resulting in the trailing SONEY BEATT being checked by a dislodged pylon”.
Mr Renault confirmed Mr May had admitted the breach and that he did not want to be present at the hearing.
Rule 869(7a) (b) provides as follows:
(7a) Every horseman who moves inwards shall ensure:
(b) that any part of the sulky does not protrude inside the marker line.
Mr Renault with the assistance of Mr Quirk identified Mr May racing 3 back on the rail approaching the home straight. He pointed to Mr May in the straight, steer his horse inwards into a very tight gap. Mr Renault said at this stage there wasn’t enough room and Mr May’s inside sulky wheel could be seen well inside the pylons resulting in several being run over and dislodged. He pointed to SONEY BEATT (Miss S Tomlinson) running into one of the dislodged pylons and galloping.
Submissions for Penalty:
Mr Renault said Mr May had a clear record under this rule. He said the Guidelines indicated a $200 fine or a 4-drive suspension. He asked the Committee to consider that a horse had its chance in the race ended and that an uplift in penalty was warranted. He said Mr May’s record and admission was a factor and a fine of $200 to $300 was the Stewards recommendation.

The JCA penalty Guidelines for the rule provides a $200 fine or a 4-drive suspension.
In determining penalty, the Committee considered the aggravating factor being a horse’s chances were extinguished.
The mitigating factors are Mr May’s good record and admission of the breach.
The Committee having regard for the above factors, considered a fine of $250 was an appropriate penalty in this case.
