Following the running of race number 3 an information was lodged by Stipendiary Stewards under rule no. 867 alleging that Mr Kerr (Xanthos) drove for a considerable distance with his foot out of the sulky rest rounding the final bend.

The relevant rule reads:

“867
--Every horseman shall drive throughout the race with both feet in the rests of the sulk provided for that purpose.”

The Committee noted that Mr Kerr admitted the breach and did not wish to be present. Mr Ydgren said that the Stipendiary stewards observed Mr Kerr’s foot out of the sulky rest for approximately 200 metres rounding the final bend and that Mr Kerr had readily accepted his fault. The charge is accordingly found proven.

Mr Ydgren in respect of penalty advised the Committee that Mr Kerr indicated to the Stipendiary Stewards that he would prefer a suspension rather than a fine. Mr Ydgren advised the meetings that Mr Kerr was likely to drive at. The Committee notes that Mr Kerr requested a suspension rather than a fine and, accordingly, Mr Kerr’s licence is suspended from the completion of racing today, 14 December 2008, until the completion of racing on Tuesday 23 December 2008.
